最高人民法院7月26日公布的《关于解除劳动合同的劳动争议仲裁申请期限应当如何起算问题的批复》（法释8号，以下简称《批复》）规定：用人单位因劳动者被依法追究刑事责任而解除劳动合同并因此而发生劳动争议的，劳动者申请劳动争议仲裁委员会仲裁的期限自劳动者收到解除劳动合同书面通知之日起计算。
《批复》明确了用人单位依据《劳动法》第二十五条第（四）项的规定解除与劳动者之间的劳动合同应当书面通知劳动者。《批复》特别强调了一点：解除劳动合同不能以口头形式通知劳动者，而必须是以书面形式通知才能发生解除劳动合同的效力。
虽然《批复》仅是针对《劳动法》第二十五条第（四）项的情形作出的规定，其精神也应当适用于用人单位依据该条前三项规定的情形。也就是说，用人单位依据《劳动法》第二十五条规定，因劳动者的过错而解除劳动合同时也应当履行程序性义务。这种义务包括两个方面：
第一、用人单位应当有解除合同的意思表示。《劳动法》第二十五条规定，当劳动者存在重大过错时，用人单位“可以”解除劳动合同。如果用人单位不作出解除的意思表示，就难以判断用人单位是否有解除合同的主张、是否行使了解除权。
第二、用人单位应当将解除合同的意思表示书面通知劳动者。未经通知，解除合同的意思表示应当不对劳动者产生法律效力。劳动合同自劳动者收到通知时解除。
