1、学生的监护人是学生的父母或依法确定的监护人，其监护关系不因学生的入学而转移给学校。学校与学生只是教育管理关系。因此学生在校期间因个人原因造成他人人身或财产损害的，由其监护人承担赔偿责任。
2、学生在校生活、学习期间，因第三人的原因造成身体受到伤害，一般由第三人承担赔偿责任；如果学校有过错的，按学校过错的`大小确定学校应承担相应赔偿责任；因学生个人原因造成他人损害的，由学生或其监护人承担赔偿责任。构成犯罪的，移交司法机关处理。
3、符合下列条件可确定学校无过错∶
（1）损害事件的发生与学校的设施无关，或者虽与学校的设施有关但学校的设施并无缺陷；
（2）学校或老师履行了应尽教育管理职责，损害事件仍不可避免地发生。
4、学生放学后应立即离校回家，非学校或老师的原因学生在校内滞留嬉戏玩耍、造成伤害的，学校不承担赔偿责任。住校生要严格遵守学校住校生管理制定，严格遵守作息时间，不得随意借住校外，更不得容留非住校生和社会人员。否则造成的一切后果，责任自负。
5、严禁教职工体罚或变相体罚学生，如因此造成后果的由教职工本人负责，但教职工履行职责，进行正常的批评教育，出现意外后果后，教职工或学校不负责任。
6、学校开展校内外集体活动，因学生不听指挥，违背有关纪律，造成意外伤害的，学校不承担责任；日常上课期间，学生未到校或私自离校，学校履行正常的告知责任，因此造成社会危害或出现意外事故的，学校不承担责任。
7、学生应严格遵守交通规则，出现交通事故的，由肇事方负责，学校不承担责任。
8、学校严禁玩火、玩电、玩水、玩鞭炮、刀具、棍棒等器物，因此发生赔偿纠纷，均由肇事方承担责任。
9、学校加强食品安全卫生知识教育，学生在校外食宿造成意外后果的，学校不承担责任。
